Terms and Conditions

Before using my services on anaretouchme.com, represented by Oleksandr Trishkin, please read these Terms and Conditions carefully. Note that any violation of these Terms and Conditions may result in termination of my services to you. I reserve the right to change these Terms and Conditions without prior notice.

1. My Services

I offer digital retouching services to clients in many countries of the world. I am based in Ukraine. I support my clients primarily through email communication and I do not offer phone support.

By using my services you agree that I will not be responsible for any liability, loss, damages, or expenses including legal fees related to the use of my services or the violation of this agreement. I have no liability whatsoever for your use of any information or service on this site. No communication with me whether oral or written shall create any warranty or guarantee.

2. Submissions

By submitting any digital images you grant me a non-exclusive, royalty-free license to use, transmit, modify, copy, display, and edit to complete your order. After receiving your files, I guarantee that they will not be shared with third parties and will not be published anywhere for public viewing. Your images may be used for my portfolio (before and after) with the names or credits of the photographer, model(s), and other participants, but only with your permission.

By accepting my quote and transferring images for me to work on, you agree that you understand copyright laws and the fact that all images are royalty-free and do not violate any laws. Using my services excludes any of the following materials:

• Any content that is unlawful, pornographic, abusive, inappropriate, threatening, promoting racism or harm against any individual or a group.
• Any materials containing software viruses or computer codes, programs, or files, destroying, interrupting, or limiting the functionality of any computer equipment and software/hardware.
• Content that could infringe copyrights, rights of privacy, or other intellectual property rights without the permission of the owner of these rights and the persons who are shown in the material.

3. Data Storage

I do not offer data storage services to any clients. I keep your finished photos for 1 week, please pay attention to this and download your files as soon as you receive the link. I do not take any responsibility for the deletion of your upload.

4. Payment and Prices

When you place your order you will be required to make a full payment of the order.

My prices are indicated in United States dollars ($). All prices listed on this site are given for reference only. My retouching rates may vary depending on every individual project. Every client has very specific needs and requirements, therefore, I quote each project as a separate entity regarding the complexity of the work. I also give an estimated time that is required for the project to be finished. Clients state that the billing and shipping information is given accurately and you agree that I am not to be held liable for any delay in services that result from inaccurate contact details.

Surcharge:

• Extra people in the photo incur an additional charge of 10% per person.
• Remove/change the background, remove/relocate/add an object(s) +30%.
• Urgent orders (less than 3 days) +50% payment.

5. Rejections

I reserve the right to reject any images that I believe to be inappropriate or illegal in nature. I reserve the right to refuse to provide my services to any client without a detailed explanation if the files sent by the client cause me any suspicion, and also, if the customer indulges in rude communication or shows disrespect in any way. I also reserve the right to reject any images that I believe cannot be retouched to the client’s satisfaction.

6. Turnaround Time

The order fulfillment period lasts from 3 to 7 days on average. It depends on my workload, the level of processing complexity, and the quantity of photos. The following times are estimates and for your information only:

• Close-up Portrait up to 5 images - 3-5 business days.
• Studio Shooting 10-20 images - 3-7 business days.
• Photo Montage & Manipulation (add or remove the object, change background) up to 5 images - 3-10 business days.
• Batch Photo Processing (color correction) up to 200 images - 3-5 business days.

The turnaround time frames indicated above do not imply a guarantee. Actual ones may vary depending on the workload and you will be notified of the approximate times well in advance. I do my best to come up with a draft within 72 hours that the customer can evaluate. The countdown to the completion of the work begins from the moment of the end of the dialogue with the client about the coordination of all details and agreements. Urgent orders (less than 3 days) are accepted with an additional 50% payment. However, no more than 5-10 photos (depending on complexity and workload).

7. Technical Requirements (TR)

Technical Requirements (TR) are important for a better understanding of your photo processing wishes. The more detailed you describe your TR, the more likely you'll be satisfied with the result without additional edits. For free, I can make edits only within technical requirements, no more than 2 times. Please note that edits are made within 3 days from the moment of sending the finished photos. Additional corrections that were not discussed and were not included in the price at the beginning are made after extra payment. If you have references (examples) for color correction/skin tone etc., please share them with me. Please be sure to write your TR, voice messages are not accepted to prevent misunderstandings. If you do not provide TR, I will do the processing at my taste and discretion. However, please note that in this case any changes will be made after additional payment.

Please don't forget to include everything that needs to be left UNCHANGED, for example: moles, freckles, scars, tattoos, wrinkles/folds on clothes/objects on the background, etc.

8. Refund Policy

I will do my best to satisfy my client’s requirements. It is my basic interest that clients should be happy with the service I provide. However, there might be cases in which some dissatisfaction occurs in connection with the work done. In this case, I prefer clear communication and will revise the images according to the criteria you gave me (TR). This means that BEFORE the final version of the image is delivered to the client, I am open to modifying the image or images. But after the final version has been decided and you have agreed to it, I will finalize the image. After that, I don’t offer any refund since I invested my time. During work, you will be shown the progress so you will have a chance to tell me if the work is progressing in the direction that you imagined.

9. Royalty

All the images that I will work on and will complete are royalty-free images. It means that once you paid for my services, you can use those images anywhere you want.

10. Free Trial

I do not provide such a service as processing free test photo. If you want to check the quality of my work, I can process 1 test photo for you in the shortest possible time (fully paid).

11. Canceling the Services

You can cancel your order until your payment is processed and done. Once the amount for the service is paid, in no way can the original contract be changed. The work will be done and you will get what you have paid for. I reserve the right to terminate the service at any time during the work under conditions of unforeseen circumstances, force majeure, or other personal reasons. In such a case, I will make a refund for the part of the work that has not been done.

12. Photo Replacement

I do not accept photo replacements after the service is delivered. If you sent me the wrong image or images or instructions and the order was completed, you are not allowed to ask me to edit another photo for free as a replacement. You agree that you are responsible for the consequences of sending me the wrong photo or instructions.

13. Revision Policy

I provide you flexibility, therefore, you will have a chance to give me continual feedback on the quality of my work. We will be in contact during the work and you will be able to see how your images turn into the images that you have imagined. During processing, I will take into account your comments, wishes, and observations, if they correspond to your original TR. Once the work is finalized and you accept the final version, I will not make any more changes. The final images will be sent and your case will be closed and cannot be re-open ed. In case you need additional changes to already finished photos, it will be evaluated as a new project and you will need to issue a new order for the same images to be retouched.

14. Language

All the communication, technical requirements, terms and conditions, and emailing will be done in English.

15. Working Hours

My working hours are as follows:

10:00 - 17:00 (GMT +2)

I operate according to this schedule and provide responses to your messages only during the specified hours. If you have contacted me and did not receive an immediate response, please wait until my business hours.
